Our eminent panel will be discussing the recent judgment of the Court of Justice in Case C-479/21 PPU SN and SD, the approach to arrest warrants under the Trade and Cooperation Agreement (“the TCA”) more broadly and whether there is any scope for similar challenges to the Withdrawal Agreement and/or the TCA in other areas of law now that the Court has answered the question of the correct legal bases of the Withdrawal Agreement and the TCA so definitively. This should be a fascinating discussion for practitioners in the area of surrender and extradition and for all of those with an interest in the post-Brexit relationship between the UK and the EU-27.
