Five years on from the hard Brexit from the EU which cut the UK off from using the private international law instruments of the EU and removed the UK from the zone of mutual trust between the national courts of the Union, what rules apply in civil and criminal litigation?
Clearly a substantial volume of cross-border litigation remains but the issue for litigators is how much grit has been added by Brexit to the resolution of cross-border disputes. What will be the effect of the entry into force of Hague 2019 in the UK on 1 July 2025?
We will start this event with a keynote from the UK’s last judge at the Court of Justice, Christopher Vajda KC and there will be practical sessions by UK and EU experts which seek to drill down on the up to date position first for civil justice and, after lunch, for criminal justice.
Some might hope for progress on these fronts in the ongoing EU-UK discussions under the Trade and Cooperation Agreement but any progress would take time and the starting point must be to assess the current position on the ground. To drill down in the different areas of legal practice, we have assembled a team of experts from the UK, France and Belgium to compare notes and analyse how the practical hurdles erected by Brexit are being managed.
